Customer Content

You retain all rights in the data and content you submit through the Services ("Customer Content"). By using the Services, you grant Fortyx a limited, non-exclusive, worldwide licence to process, store, and transmit your Customer Content solely as necessary to provide the Services to you.

Fortyx may process Customer Content for the following purposes:

• Email analysis (e.g., scanning for phishing, impersonation, and malicious content)
• AI detection (e.g., identifying AI-generated or manipulated content)
• Risk scoring (e.g., assigning threat levels to emails and communications)
• Security event logging (e.g., recording and alerting on suspicious activity)
• Policy enforcement (e.g., enforcing data loss prevention rules)
• Technical support (e.g., troubleshooting issues reported by you)

We do not use Customer Content to train models or for marketing, without explicit written permission.

Limitation of Liability

To the maximum extent permitted by law, Fortyx Technologies Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, whether incurred directly or indirectly, arising from your use of or inability to use the Services.

In no event shall the total aggregate liability of Fortyx under these Terms exceed the greater of (a) one hundred pounds sterling (£100) or (b) the total amounts paid by you to Fortyx in the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

Indemnification

You agree to indemnify, defend, and hold harmless Fortyx Technologies Ltd, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your infringement of any third-party rights.

Termination

Either party may terminate this agreement in accordance with the terms of the applicable subscription plan. We reserve the right to suspend or terminate your access to the Services immediately if you violate these Terms. Upon termination, your right to use the Services will cease immediately, and we may delete your account data in accordance with our data retention practices.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
